There is a Constitutional separation of church and state, and no government organization can tell any religion that they must change their views on marriage equality. One of the issues that came up repeatedly during the Prop. 8 campaign was the false accusation that the government would force religious institutions to perform same-sex marriages. While we fully-support any religious organizations that choose to do so, civil marriage laws could never make a church or synagogue perform or recognize a same-sex marriage; only the government would recognize the legality of the marriage. To use a similar example to demonstrate the separation of church and state on this issue, the Catholic Church can choose not to perform a ceremony for someone who has been legally divorced under civil law. That person can legally remarry, but the Church could choose not to recognize it. Similarly, where same-sex marriage is legal, couples can marry under civil law, but religious organizations can choose not to acknowledge the union.
